Terms of Service

Article 1 (Scope)

These Terms of Service set forth the conditions for using Aqua Canvas (hereinafter "the Service"). Users shall use the Service upon agreeing to these Terms.

Article 2 (Service Description)

The Service is an online community service that allows users to draw illustrations, assign names and personalities to them, and let them swim together with creatures created by other users in a virtual aquarium.

Article 3 (Account Registration)

1. Account registration is required to use the Service.
2. Information provided during registration must be accurate and current.
3. Users are responsible for managing their accounts and may not transfer or lend them to third parties.
4. Users are responsible for password management, and we are not liable for damages caused by unauthorized use.

Article 4 (Prohibited Activities)

Users shall not engage in the following activities:

• Acts that violate laws or public order and morals
• Acts related to criminal activities
• Acts that infringe on the rights of other users or third parties
• Posting obscene, violent, or discriminatory content
• Acts that cause discomfort to other users
• Acts that interfere with the operation of the Service
• Unauthorized access or attacks on systems
• Unauthorized commercial use
• Other acts deemed inappropriate by us

Article 5 (User Content)

1. Copyright of content such as illustrations posted by users on the Service (hereinafter "User Content") belongs to the users.
2. Users agree to have their User Content displayed and published on the Service.
3. We may use User Content for promotional and service improvement purposes.
4. Posting content that infringes on third-party rights is prohibited, and users are responsible for any issues that arise.

Article 6 (Service Changes/Suspension)

We may change or suspend all or part of the Service in the following cases:

• When performing system maintenance or updates
• When provision becomes difficult due to natural disasters, accidents, or other force majeure
• When we deem it necessary for other reasons

We are not liable for any damages to users caused by changes or suspension of the Service.

Article 7 (Account Suspension/Deletion)

We may suspend or delete user accounts without prior notice if they violate these Terms. We are not liable for any damages to users resulting from such actions.

Article 8 (Disclaimer)

1. The Service is provided "as is" without warranty of fitness for a particular purpose, accuracy, or reliability.
2. We are not involved in and not liable for disputes between users.
3. We are not liable for damages arising from use of the Service unless due to our intentional or gross negligence.

Article 9 (Changes to Terms)

We may change these Terms as necessary. Changed Terms shall take effect when posted on the Service. Continued use of the Service after changes constitutes agreement to the changed Terms.

Article 10 (Governing Law/Jurisdiction)

These Terms shall be governed by Japanese law, and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any disputes related to the Service.
